These Terms of Use (the "Terms") govern your use of the Pista mobile applications for iOS and Android (the "App"), the website www.pistaapp.com (the "Website"), and related services (together, the "Service"), operated by PIXION d.o.o., Rudeška cesta 179, 10000 Zagreb, Croatia ("Pista", "we", "us", or "our").

By accessing or using the Service you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree with any part of these Terms, please do not use the Service.

Pista is a race starter and vehicle performance tracker. It uses your device's GPS (and, optionally, external GNSS devices such as RaceBox or Dragy connected via Bluetooth) to measure acceleration, speed, distance, and race times in solo runs, head-to-head races, and time trials, and provides results, statistics, and rankings.

You must be at least 16 years old to create an account and use the Service. To operate a motor vehicle while using the Service, you must additionally hold a valid driving licence and comply with all applicable laws. By using the Service, you represent that you meet these requirements.

Pista is a measurement tool. It does not make driving at speed safe or legal. By using the Service, you agree that:

We strongly encourage you to use the Service exclusively at organized, legal motorsport venues and events.

Regulations vary from state to state and country to country, and their interpretation and enforcement can vary considerably — even among enforcement agencies within the same region. It is your responsibility to evaluate and comply with the local regulations and enforcement practices that apply to you before using the Service.

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity that occurs under your account. Usernames must not be offensive, misleading, or infringe the rights of others; we may reserve, block, or require changes to usernames that violate these rules. Notify us immediately at info@pistaapp.com if you suspect unauthorized use of your account.

You may upload content to the Service, such as a profile photo and photos of your cars ("User Content"). You retain ownership of your User Content. By uploading it you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and reproduce it solely for the purpose of operating and providing the Service. You represent that you have the rights to any User Content you upload and that it does not violate any law or the rights of any third party. We may remove User Content that violates these Terms.

In addition to other prohibitions set out in these Terms, you must not use the Service:

We reserve the right to suspend or terminate your use of the Service for violating any of these prohibited uses.

The Service can connect to third-party hardware (such as RaceBox and Dragy GNSS devices) and relies on third-party services (such as sign-in providers and map services). We do not manufacture, control, or warrant third-party devices or services, and your use of them is subject to their own terms and policies. Measurement accuracy depends on your device hardware, GPS signal quality, and environmental conditions, and is provided for informational and entertainment purposes only.

The Service, including its software, design, logos, and content (excluding User Content), is owned by Pista or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal devices for your own non-commercial use. You must not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of any part of the Service except as permitted by law.

Occasionally, information on the Website or in the Service may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. We assume no obligation to update any information in the Service except as required by law.

You may stop using the Service and delete your account at any time in the App's settings. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if required by law, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) survive.

We do not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the use of the Service (including measured times, speeds, and distances) will be accurate or reliable.

You agree that from time to time we may suspend the Service for indefinite periods or discontinue the Service at any time without notice. The Service is provided "as is" and "as available", without any representations, warranties, or conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

To the maximum extent permitted by law, in no case shall Pista, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind — including, without limitation, personal injury, death, vehicle damage, fines or penalties, lost profits, lost data, or replacement costs — arising from your use of the Service, your driving or racing activity, your reliance on measurements produced by the Service, or any third-party device or service used with it, whether based in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify, defend, and hold harmless Pista and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, your violation of any law (including traffic laws), or your violation of the rights of a third party.

These Terms and any separate agreements whereby we provide you the Service shall be governed by and construed in accordance with the laws of the Republic of Croatia, without prejudice to any mandatory consumer protection rules of the country in which you reside. Any disputes shall be subject to the jurisdiction of the competent court in Zagreb, Croatia, unless mandatory law provides otherwise.

We may update these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date. By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms.
